Determining if divorce mediation is the right choice for you

On Behalf of | Jul 16, 2019 | Divorce Mediation

In our blog, we talk about the advantages of divorce mediation quite often. Our lawyers believe in mediation and have observed how it makes the process of ending a marriage easier in most cases. However, as we have said many times, mediation does not work for all White Plains couples.

In today’s post, we want to shift the focus from when you should absolutely try mediation to when you may need a different solution. We felt a good way to do this is by offering our readers three situations in which divorce mediation may not be wise. Before continuing, we also want to say that getting advice from an attorney can help you decide how to move forward.

Violent and abusive marriages: In most abusive relationships, the abuser is not able to view the situation from the other spouse’s perspective. It may be safer to proceed with a traditional divorce instead.

Inability to self-advocate: When one spouse cannot stand up to the other spouse, divorce mediation may fail. The process works best when both parties feel comfortable speaking out and advocating for their rights individually.

Anger, hatred or desire for revenge: When one or both spouses continue experiencing a high volume of negative and/or vengeful emotions, mediation may be futile. Divorce mediation benefits greatly from a shared desire to cooperate in the goal of ending the marriage as smoothly as possible.

Please do not let the situations above discourage you from learning more about divorce mediation. In many cases, the process could still work even if you and your spouse have a difficult relationship. Feel free to continue reviewing our website to learn more about your divorce options in New York.
